The decision was made after the 30-year-old broke COVID protocol for the second time the season, when he travelled to his home in British Columbia in December, while positive for COVID-19. Kane then failed to report back to San Jose at the agreed upon time.
Kane's original infraction came this fall when it was determined that he had acquired a fake COVID-19 vaccine card in an attempt to get around having to receive the vaccine. Kane earned a 21-game suspension from the NHL for breaking protocol, at the conclusion of which, the Sharks waived him for the purpose of assigning him to the AHL's San Jose Barracuda.
The gritty winger's personal life has been in the public eye for much of his NHL career, which has led to him being moved from Atlanta/Winnipeg to Buffalo and then to San Jose, with Kane being labelled as a distraction in the room by many of his former teammates.
Should Kane not win the grievance, he will lose out on a little under $23M in salary.
