Sean Higgins, who was charged in the tragic incident that took the lives of Matthew and Johnny Gaudreau has made a ridiculous ask in relation to his charges.

The hockey world was struck with tragedy at the end of August last year when it was revealed that Columbus Blue Jackets star Johnny Gaudreau and his brother Matthew
passed away after being struck by a drunk driver
The incident occurred as the brothers were riding their bicycles on their way home from their sister's wedding rehearsal dinner the night before her wedding.
Tributes across the hockey world poured in and at the beginning of the NHL season, teams honoured the brothers in their own ways, culminating with the Blue Jackets raising a banner in their memory.
The charged and accused, Sean Higgins, reportedly drank six alcoholic beverages prior to the incident and was found to have a blood-alcohol level of .087, which was above the legal limit.
Higgins was handed a number of charges, but pled 'not guilty' after rejecting a plea deal in January. Now, Higgins and his legal team are planning to ask to have his indictment dismissed according to NJ.com.
Also included in the updated filings, Higgins' representatives noted the BAC levels of the Gaudreau brothers were significantly higher than his, which led to them releasing the following statement.
"We believe these filings are essential to ensuring that our client's Constitutional rights are protected and that he is not being treated unfairly based upon the amount of publicity being garnered," the attorneys, Richard Klineburger III and Matthew Portella, said in a statement.

It should also be noted that the new filing did not allege the BAC levels of the Gaudreau's had a role in the clash, but rather they were concerned with how the levels were collected.
The Gaudreau family and those close to them continue to mourn the loss of the brothers, whose passing became even more heartbreaking when Johnny's wife Meredith announced during her eulogy that she was pregnant with their third child.
Known for being two of the most humble people in the hockey community, the legacies of Matthew and Johnny Gaudreau will live on through the stories and memories they created with those whose lives they touched.
